I: GENERAL PROVISIONS
Art.1. This Code establishes ethical norms and rules of conduct for brokers and employees of REAL ESTATE AGENCY Ltd.
Art.2. The purpose of the Code is to form an organizational culture conducive to the promotion of the good name of REALINA PROPERTIES Agency. It also establishes a Standard of Conduct aimed at guaranteeing the rights and protecting the interests of clients, as well as enhancing public confidence in the professionalism and morality of the Agency's employees.
II: BASIC PRINCIPLES
TRUST AND INTEGRITY
Art.3. Relationships within the REALINA team (brokers, broker-managers, administrators, junior brokers and other employees), as well as those with clients, are based on honesty, integrity and empathy.
Art.4. Respect and consideration for the person and dignity of others are inherent duties of each team member.
COMPETENCE AND PROFESSIONALISM
Art.5. The brokers, junior brokers and broker-managers of REALINA continuously improve their qualifications, advising their clients according to the current changes in the real estate market.
Art.6. Brokers and other members of the REALINA team shall contribute to professionalism in the field of real estate brokerage by observing good business practices, avoiding practices that discredit the profession, and sharing their experience with colleagues.
PRIVACY
Art.7. The people of "REALINA" keep the clients' secret and do not disclose confidential information. This includes personal data, ownership information, financial data and details of concluded transactions.
Art.8. Each member of the team requires the collaborating persons to keep the client's information confidential.
Art.9. The disclosure of confidential information shall only be possible if expressly required by law before a competent authority.
LOYALTY AND IMPARTIALITY
Art.10. Brokers shall perform their duties impartially, protecting the legitimate interests of clients, while treating all parties involved fairly and with integrity.
EQUALITY
Art.11. Brokers shall observe the principle of equality in their relations with clients and business partners without distinction of nationality, race, ethnicity, age, gender, political or other beliefs.
III: CUSTOMER RELATIONS
Art.12. REALNA brokers provide their services to clients (buyers, sellers, tenants, landlords or other clients), respecting the principles of equality, fairness and integrity. Services are provided in accordance with all legal requirements, the Agency's General Conditions of Mediation and commercial practices in the Republic of Bulgaria for real estate.
Art.13. Brokers shall maintain communication with clients, respecting the good manners and personality of each client.
Art.14. REALINA brokers do not take advantage of the incompetence or health condition of clients.
Art.15. The interests of the clients shall always prevail over the personal interest of the Agency's employees. Transactions which do not serve the interests of the clients or are detrimental to them shall not be permitted.
Art.16. REALINA brokers and employees do not hide or change information about the properties offered and act with understanding and empathy for the needs of clients.
Art.17. Brokers shall provide and acquaint each client with the General Terms and Conditions of the Agency, informing clients in advance of all costs associated with the transaction. Verbal agreements shall be formalized in a written agency contract. Brokers shall inform clients in advance of the firm's policy on cooperation with other real estate agencies and third parties to whom contractual or legal consideration is due.
Art.18. Before signing contracts and agreements with clients, brokers shall ensure that the documents are clear, contain all necessary clauses and are understood by the parties to the transaction.
Art.19. Brokers who have carried out mediation shall assist their clients in providing the necessary documents for the conclusion of contracts and shall not be entitled to additional remuneration, unless otherwise agreed.
Art.20. Brokers provide useful advice to their clients using their experience and knowledge of the real estate market, including information on improving the commercial appearance of properties and investment opportunities.
Art.21. A broker from REALINA may represent both parties in the same transaction after disclosing this fact to the parties and obtaining their written consent.
Art.22. The broker shall notify the client of any proposals as soon as possible.
Art.23. The broker who mediates in transactions with mortgage loans shall inform the clients in advance about the specifics of these transactions and provide the necessary consultation and assistance in collecting the necessary documents.
Art.24. When selling/renting their own property or buying/renting a property for themselves, REALINA brokers follow the rules of the Code of Ethics.
IV: RELATIONS WITH PARTNERS
Art.25. Partner agencies include all real estate agencies from the Republic of Bulgaria and abroad, with which "REALINA" maintains or may establish contact in the course of and in connection with the implementation of intermediary activities in the interests of its clients. Interactions with partner agencies and individuals are established on the basis of the principle of equality, mutual benefit and previously clarified expectations and commitments in writing.
Art.26. The brokers of REALINA cooperate with each other and with brokers from other real estate agencies, with the cooperation being in the interest of the client. Brokerage actions are carried out quickly and efficiently for the benefit of the client.
Art.27. Relations with partners require honesty, professionalism, competence and integrity from all members of the REALINA team. Brokers provide accurate and reliable information about properties, highlighting their advantages and sharing information about their disadvantages.
Art.28. Fair treatment of partners is that which is consistent with good commercial practice, does not prejudice their interests and does not constitute a threat to them.
Art.29. REALINA brokers actively exchange information and cooperate with partners, promoting the application of ethical standards in real estate transactions.
Art.30. When a broker of REALINA receives exclusive rights for the sale of a property, he shall take prompt action, offering cooperation to partners and arranging viewings for clients of these partners. The financial aspects shall be settled in a written contract.
Art.31. When offering non-exclusive properties, brokers may not refuse to cooperate with other brokers who may represent potential buyers or tenants. Financial relations shall be settled in advance in a written contract.
Art.32. If a broker has a personal interest in the transaction, he shall notify the opposite party thereof.
Art.33. Communication with partners shall be carried out with respect for the rules of good manners and respect for persons.
V: TEAM RELATIONS
Art.34. The employees and associates of REALINA form a cohesive and well-organized collective, united by common values and principles. This team works synergistically, aimed at increasing professionalism and individual competence, in order to achieve the company's objectives and the successful implementation of company policy. The interaction within the team involves sharing experience and professional knowledge with each other.
Art.35. Each team member commits to actively participate in the process of building trust in the team and the company. Through his/her actions, he/she shall strive to maintain and improve the image of REALINA Real Estate Agency in the community.
Art.36. The people in the team of "REALINA" work in harmony and agreement with each other, following the principles of collegiality, mutual assistance and honesty. They create relationships based on trust, respect, collegiality and tolerance. When communicating with colleagues, good manners and respect for the personality of others are observed, avoiding the dissemination of false information or distortion of facts.
Art.37. Each member of the team shall be sympathetic to the professional problems of his colleagues.
Art.38.
- (1) Team members work in a spirit of interchangeability and mutual support. (2) Team members support each other in all aspects of their work, declaring their willingness to responsibly support all colleagues. This includes:
- Resolving issues or disputes,
- Negotiating with customers,
- Resolving case studies and other work-related issues,
- Discussion of issues and problems arising,
- Active participation in common decisions.
Art.39. The people of the REALINA team express their willingness to constantly improve their professional qualifications, knowledge and skills in the interest of the clients and the common goal.
Art.40. Each member of the team is personally committed to creating a positive and creative working atmosphere.
Art.41. The people of the "REALINA" team keep the company secret and the confidentiality of the clients. No one shall divulge confidential information. The disclosure of such information shall only be permitted in the event of an express legal obligation before a proper authority (court, prosecutor's office, investigation or other institution).
